There's no crime in selling GIMP.

The bigger crime might be the stolen images with a copyright plastered all over them...

False advertising... this is Gimp 2.8 and it says it runs on Win98/ME... (not sure about WinNT and Win2000 status, either)

Point being for the OP, if there is an issue it's with them not with GIMP. There is no problem with selling GIMP in and of itself.

Source code must, however, be made available; I've contacted the ebay seller to ask about that. Making it available may be as simple as pointing people to ftp.gimp.org if there are no modifications.
