Why doesn't the transparent layer scale with the photograph?

Why doesn't the transparent layer scale with a photograph? It’s a real PITA to get rid of it. BTW, how do you scale the transparent layer to match the scaled photo (or delete it)?

1) what transparent layer?

2) if you use Image>Scale image, all layers are scaled together
